The website ponchowear.com is operated by Vcommerce, doing business as Ponchowear. These Terms of Sale govern all purchases made on our website.

1. Order Acceptance

By placing an order, you make an offer to purchase the selected product(s) at the listed price. We reserve the right to accept or decline any order at our discretion. Your order is confirmed once you receive an order confirmation email from us.

We reserve the right to cancel confirmed orders in cases of pricing errors, stock unavailability, or suspected fraud. In such cases, you will be fully refunded.

2. Pricing

All prices are listed in US dollars (USD) and are subject to change without notice. Applicable sales taxes will be calculated and displayed at checkout based on your shipping address and applicable state/local tax laws.

3. Payment

We accept the following payment methods: Visa, Mastercard, American Express, Apple Pay, PayPal, and Klarna. Payment is processed securely at checkout. Your card will be charged at the time of purchase.

We use industry-standard SSL encryption to protect your payment information. We do not store full credit card numbers.

4. Shipping & Delivery

Orders are processed within 1–3 business days. Estimated delivery times:

United States: 7–14 business days
International: 14–21 business days

Delivery times are estimates only. Ponchowear is not responsible for delays caused by carriers, customs, or force majeure events.

Risk of loss and title for items purchased pass to you upon delivery to the carrier.

5. Returns & Refunds

Please refer to our Return & Refund Policy for full details. In summary:

Returns accepted within 30 days of delivery
Items must be unused, unworn, and in original packaging
Refunds issued to original payment method within 5–10 business days of return approval

6. Product Descriptions

We strive to provide accurate product descriptions, images, and specifications. However, we do not warrant that product descriptions or other content is complete, reliable, current, or error-free. Colors may vary slightly from what is displayed on screen.

7. Promotions & Discount Codes

Promotional offers and discount codes are subject to specific terms and expiration dates. Only one promotional code may be applied per order unless stated otherwise. Ponchowear reserves the right to modify or terminate promotions at any time.

8. Limitation of Liability

To the fullest extent permitted by law, Ponchowear's liability for any claim arising from a sale shall not exceed the purchase price of the product(s) at issue. We are not liable for any indirect, special, or consequential damages.

9. Governing Law

These Terms of Sale are governed by the laws of the State of Delaware, United States. Any disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association, except for claims seeking emergency injunctive relief.
